WHO WE ARE

230 Career Limited and/or any other parent, subsidiaryy, sister or any affiliate companies (hereinafter ‘230 Careers, ‘ZD Group,Us’, ‘Our’, ‘We’,) are the data processor as defined by the Data Protection Act (Chapter 586 of the Laws of Malta) (the “Act) and the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR’’).

OUR APPROACH TO PRIVACY

We know how valuable and important your personal data is to you. We have therefore worked on a set of rules meant to protect your data and your interests while assisting you to/a find the job of your dreams.

DATA WE PROCESS ABOUT YOU

We collect, hold and process the below categories of personal data about you, this may include, but is not limited to:

  • Personal details such as your name, address, e-mail address, telephone number, date of birth or age, gender, marital status, ID Card or Passport Number;
  • Additional information about your education, work experience, languages spoken and skills; your current and previous employment and occupation, including your salary; and
  • Your marketing preferences.

With respect to certain job opportunities, we might need to be furnished with additional “sensitive” personal information relevant to the specific role e.g. current state of health, existing conditions, etc. (this is referred to as “Special Categories of Personal Data”).

We will immediately destroy all personal data held by ourselves deemed irrelevant.

USE OF PERSONAL DATA ABOUT YOU

We will collect and use your Personal Data only when allowed by the law or required for us to render our services to you. We will use your Personal Data:

  • for the purpose of matching your skills with the ones required by employers who avail from our recruitment services;
  • to share your details to our clients / prospective employers for you to be considered for vacancies;
  • to assist our clients in the drafting of a job offer or your employment agreement, or any other ancillary services related to your employment if requested and required by them;
  • to keep you informed of available opportunities as they arise from time to time;
  • for training purposes and to improve our services and their delivery, including the recording of telephone calls;
  • to assist you and increase chances of being selected and gain employment by various employers; and
  • to contact you about service-related announcements.

We may also use your Personal Data where it is needed in the public interest.

OUR INTEREST TO SEND TIPS AND RECCOMENDATIONS

We have an interest to assist you and any other job seeker to find the job of your dreams, and for this reason we will request your consent to send information that can help increase chances of employment such as attendance to courses or suggestions e.g. as to how to deal with client specific interviews.

In this respect, we will include a link which will allow you to unsubscribe to such emails on each and every mailing.

We will only send you information regarding our services only upon receipt of your consent.

WHAT HAPPENS IF YOU DO NOT PROVIDE US WITH YOUR PERSONAL DATA

If you do not provide certain Personal Data when requested, we may not be able to perform the service we have promised to provide you with (such as sharing your details with employers possibly interested in your profile), or we may be prevented from complying with our legal obligations.

HOW WE USE SPECIAL CATEGORIES OF PERSONAL DATA (“SENSITIVE INFORMATION”)

Rest assured that we will only process Personal Data for purposes compatible with this Data Protection and Privacy Statement and in order for us to fulfil our legal obligationsOn the occasion that we require your “sensitive” information, we will only do so:

  • In order to fulfill legal obligations;
  • If needed in the public interest; and
  • If we need to assess your working capacity on health grounds, subject to appropriate confidentiality safeguards.

In addition to the above, although unlikely to happen, we may need to process your Personal Data if needed in relation to legal claims or if needed to protect your interests if you are not capable of giving your consent, or where you have already made the information public.

HOW WE SHARE YOUR PERSONAL DATA WITHIN THE ZD GROUP

We may share and aggregate your Personal Data across the ZD Group, including Personal Data held within the ZD Group. We may share this personal data to:

  • help us identify job opportunities and services that may be of interest to you, to tailor and package our products and services; and
  • to conduct customer research and develop marketing campaigns.

We may, as a matter of law, and without requiring notice or consent, use your information for crime and fraud prevention, systems administration within the ZD Group and to monitor and/or enforce ZD Group’s compliance with any regulatory rules and codes.

HOW WE SHARE YOUR PERSONAL DATA OUTSIDE OF THE ZD GROUP

We will ensure that your Personal Data is processed in a manner that is compatible with the purposes indicated above.
For the stated purposes, your Personal Data may be shared with, and processed, where applicable by prospective employers willing to engage persons with your same background.

Your Personal Data may be disclosed when we believe in good faith that the disclosure is required:

  • to protect the safety of our employees;
  • to comply with a judicial proceeding, court order or legal process;
  • in the event of any contemplated or actual reorganisation, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock or other related transaction; and/or
  • for the prevention or detection of crime (including fraud).

In order to prevent and detect fraud, we may share your Personal Data with regulatory bodies in Malta or, if applicable, overseas, as well as with other public bodies including the Police and other organisations, and may undertake credit or fraud searches with relevant agencies.

In addition, depending on your marketing preferences, we may share your information with third parties who help run our marketing campaigns.

WHERE WILL YOUR PERSONAL DATA BE PROCESSED?

Your Personal Data will always be processed within the territory of Malta and will not be sent to clients based outside the European Union / European Economic Area unless requested by authorities of your country of origin (including country of residence or domicile) should you be a third country national, and in relation to matters concerning your job application in Malta.  We will not disclose your Personal Data to parties who are not authorised to process them.

PROTECTION OF YOUR PERSONAL DATA

We will take appropriate measures to protect Personal Data and Special Categories of Personal Data that are consistent with applicable privacy & data protection laws and regulations, information security industry standard, and including requiring service providers to use appropriate measures to protect the confidentiality, integrity and availability (security) of Personal Data and Special Categories of Personal Data.

DATA ACCURACY (INTEGRITY) AND RETENTION

We will take reasonable steps to ensure that the Personal Data and Special Categories of Personal Data processed is reliable for its intended use, and is accurate and complete for carrying out the purposes described in this notice. We will retain Personal Data and Special Categories of Personal Data for the period of one year from the moment of obtaining that data. Upon the expiry of one year, we will ask you whether we are still authorised to process your Personal Data. In case of a negative or lack of response we will destroy all personal data on our files unless a longer retention period is required or permitted by law.

YOUR RIGHTS

Under the General Data Protection Regulation (GDPR), there are eight data subject rights you may benefit from:

1. Right to be informed: means  the right to know how your Personal Data is being processed and for what purpose.

2. Right of access: means that you can request access to your Personal Data held by a Data Controller.

3. Right to rectification: you can request the correction of inaccurate or incomplete Personal Data.

4. Right to erasure (right to be forgotten): you can request the deletion of your Personal Data under certain circumstances.

5. Right to restrict processing: you can request the limitation of processing your Personal Data in specific situations.

6. Right to data portability: you can request your Personal Data to be provided in a structured, commonly used, and machine-readable format to transfer it to another Data Controller.

7. Right to object: you have the right to object to the processing of your Personal Data in certain circumstances.

8. Rights related to automated decision making and profiling: You may have the right to challenge and request human intervention in decisions made solely based on automated processing, including profiling.

When contacting us we kindly ask you to specify your name, email address and purpose of your request. We will do our utmost to accommodate your request in a timely manner, however, certain laws and regulation might prevent us from accessing, correcting and erase Personal Data and may, at times, be required to request further verification of identity e.g. through a copy of an ID Card, selfies holding your ID card next to your face, etc.
